NOTICE OF PARTICIPATION
to procurement procedure on evaluationservices of People’s Advocate Office institutional needs for making efficient the activity on monitoring of human rights in
theTransnistrian region of the Republic of Moldova
Context
People’s Advocate (Ombudsman) ensures the observance of human rights and freedoms by public authorities, organizations and enterprises, no matter what property type and organizational legal formis it, non-commercial organizations and persons with leading position at all levels.
According to the procedures regulated in the Law on People’s Advocate (Ombudsman) no. 52 of 03.04.2014, People’s Advocate contributes to defense of human rights and freedoms by preventing their violation, monitoring and reporting about the manner the fundamental human rights and freedoms are respected on the national level by improving the law related to the field of human rights and freedoms by the international collaboration in this field, by promoting human rights and freedoms and mechanisms for their defense.
People’s Advocate Office offers organizational, legal, informational and technical assistance to People’s Advocate, he is assisted in his Office activity which is subordinated to it, and offers organizational, legal, informational and technical assistance and it has the status of legal person. The Office can hire experts with experience in the field of human rights and other related fields for getting advisory assistance, expertise and specific knowledge.
People’s Advocate mandate of ensuring the observance of human rights is a universal one and it refers to the rights and freedoms of all persons who are under the jurisdiction of the Republic of Moldova.
Although, People’s Advocate Office has undertaken important measures for promoting and protecting the rights of persons who live on the left bank of Nistru river, as well as monitoring the situation in this region, including establishment of a regional Office in Varnita village (locality limitrophe to Transnistrian conflict), these activities are not sufficient and efficient. According to the Action Plan in the Field of Human Rights for 2018-2022,strengthening the capacities of institution in the monitoring process of human rights observance in the Transnistrian regionisthrough the priorities of People’s Advocate Office.
In this context, People’s Advocate Office launches the notice of participation to procurement procedure on evaluationservices of People’s Advocate Office (further PAO) institutional needs for making efficient the activity on monitoring of human rights observance in the Transnistrian region.
The evaluation result and the recommendations made will be used for planning the activity of People’s Advocate Office for a long time period, identification of needs for training the staff and the last, but not the least elaboration of Roadmap for the efficient monitoring and promoting of human rights in the Transnistrian region.

Main expert tasks |
The contracted expert will be responsible for realizing the following tasks:
1.Analysis of institutional needs of People’s Advocate Office for ensuring the efficiency of the activity on human rights monitoring in the Transnistrian region.
- Identification of passible instruments for being used by the People’s Advocate Office for making efficient the activity on human rights monitoring in the Transnistrian region;
- Elaboration of Roadmap for the People’s Advocate Office for implementing the instruments on making efficient the activity on human rights monitoring in the Transnistrian region;
- Elaboration of Survey on institutional (professionaland operational) needs of PAO for making efficient the process on human rights monitoring in the Transnistrian region which would follow to consist of, but not limited to:
- monitoring, promoting and protecting instruments and methodologies of human rights in the region which is de facto outside the governmental control;
- interaction/cooperation opportunity and methods with the de facto authorities, including the mechanisms of human rights protection of the Transnistrian region and with the associative sector;
- recommendations on structure and content of the Report on the situation of human rights in the Transnistrian region, a component part of the Annual Report of People’s Advocate Office on observance of human rights in the Republic of Moldova;
- aspects related to ensuring safety and security of PAO staff and persons/groups of persons who live on the left bank of Nistru river, persons which interact with PAO

Requirement toward the expert |
Education:
- Higher education in law, social sciences, political sciences, human rights or other relevant fields.
- Professional experience:
- At least 5 (five) years of professional experience in the field of human rights through which at least 2 years of consistent experience in analysis and consultancy in the field of ,,frozen conflicts,;
- At least 3 (three) years in providing advisory services on the international level will constitute an advantage;
- Experience in providing advisory services for/collaboration with the National Institutions of Human Rights Protection.
- The interested candidates can be natural persons or legal persons
- The competition is opened for national and international candidates
- The survey follows to be elaborated in one of languages: Romanian, Russian or English
- The deadline for realizing the task – November 22, 2019
- The expert could get the opportunity to develop the findings of the ”Survey on PAO institutional needs for making efficient the activity on monitoring of human rights in the Transnistrian region” in a contract further assigned by the interested PAO development partners

Content of file on participation to competition |
- Covering letter;
- CV of candidate/organization profile;
- Concept of survey which follows to be conducted;
- Methodology of elaboration of the expected product.
- Financial offer;
6 .Personal declaration on availability to undertake additional tasks within some subsequent contracts signed with the development partners, if necessary.
- The bidder will submit as a part of his/her offer, documentary evidences/links which confirm the qualifications of professional experience
- In the financial offer the total cost for the specified services will be indicated in MDL. The total gross cost includes all the fees, taxes and related social and fiscal withholdings according to current law of the Republic of Moldova. It will be also specified the number of working days for executing the tasks and providing the products with the description in details of costs by categories.
- In case of natural persons, from the total amount all the social and fiscal withholdings will be withheld and transferred to the budget according to current national law.
- People’s Advocate Office will not cover additional expenditures related to other than specified in the financial offer tasks.

Institutional arrangements |
People’s Advocate Office will sign with the expert a service supply contract, according to the conditions specified in the Notice of participation.
During the service supply process, the expert will directly communicate with the appointed responsible persons of People’s Advocate Office.
People’s Advocate Office will make the payment after the service supply based on a delivery-receipt protocol or fiscal invoice in case of legal persons.

Delayed offers will be rejected.
The candidates will be informed about the results of selection competition within 5 working days after the expiry of the term for submitting the files
