The People’s Advocate expresses his concern about the authorities’ intention to amend some provisions of the Law no.52 on the state of emergency, siege and war, this includes organizing elections or referendums and amending and / or repealing legislation in this period.
The Ombudsman consider this initiative given as an inopportune one and as a result this can lead to dangerous consequences for the rule of law, democracy and respect for fundamental rights and freedoms in the Republic of Moldova. The People’s Advocate warns that the states of emergency can be used as a reason or a pretext for suspending the rights and freedoms guaranteed by the Constitution of the state.
Mihail Cotorobai recommends to public authorities to not resort to such methods of promotion of the aforementioned amendments. It is also advisable to Members of Parliament, in this regard, to reject the proposals made by the Government.
